Trade Marks & Designs
Our Trade Marks Group, which is led by James Fish, has considerable experience in handling all aspects of trade mark protection in the UK, Europe and around the world. This includes trade mark selection and strategy, the filing and prosecution of trade mark applications before the national UK and European Community Trade Mark Offices (OHIM) and of international applications under the Madrid Protocol as well as instructing the filing and prosecution of trade mark applications widely throughout the rest of the world and opposing and defending trade mark applications. We also provide general advice and give opinions as required in particular in relation to infringement and passing off issues. The firm's trade mark clients vary from individuals to multi-nationals including many household names. We also advise on domain name disputes generally and in particular actions before Nominet (.co.uk), WIPO (.com) and EURid (.eu). The firm has been involved in numerous oppositions before the UKIPO and OHIM as well as Appellate actions in the UK before the Appointed Person and the High Court and before the Boards of Appeal of OHIM and the Court of First Instance in Luxembourg.

Our Designs Group, which is led by John Leeming and is made up of Trade Mark & Design Attorneys with design expertise, advise clients in relation to the protection of the design elements of a particular product or graphical symbol on a UK, European and global basis. This includes in relation to design selection and strategy, the filing and prosecution of design applications before the UK IPO and OHIM, as well as filing and prosecuting design applications throughout the rest of the world. We also provide opinions on validity of designs and infringement issues, and can assist in relation to applications to invalidate design registrations before the UK IPO & OHIM, or infringement actions before the UK Patents County Court. We can advise on related topics such as unregistered design right, copyright and the UK Database Right.
The group liaises with our Legal and Assignments Group in connection with changes with recordable transactions such as Assignments, licenses and security interests.
